Terms & Conditions

Thank you for considering Personal Winery Tours.

This agreement pertains to the transportation services provided by the company (here by known as Personal Winery Tours) and the conduct of customers during the service. The client must pay for any damages or cleaning charges resulting from unusual wear and tear, with the Company solely responsible for determining such wear and tear. In case of non-payment, the client will be responsible for all legal fees required for collection. Smoking and food consumption are not allowed in vehicles, and passengers are expected to behave appropriately. Any consumption of alcoholic beverages requires express permission from the company, and the possession or use of illegal substances is strictly prohibited. If any unlawful consumption or inappropriate behavior occurs, the tour guide may terminate the service, with all money forfeited. The customer must pay for any damage or defacement caused to the company vehicle during the rental period. The company has the sole discretion to determine the customer’s liability for any damages or defacement.

 

 The following is a guide to liquidated damages for the harm caused by the Customer, the Customers’ invitees, guests, etc., to a Company vehicle during the period of the Customer’s usage:


 1. Damaged window $ 500.00 ea.
 2. Bodily fluid spills/stains $ 500.00
 3. Special cleaning $ 250.00
 4. Ordinary spills/stains $ 150.00
 5. Other damage/defacement - actual costs of repair the following is a guide to liquidated damages for the harm caused by the Customer, the Customers’ invitees.

A deposit/payment is required to guarantee a reservation. Only individuals who are 21 or older are allowed to reserve a seat on the tour. The company cannot allow intoxicated individuals to participate in the tour, and customers who become too intoxicated to continue during the tour may refer to the cancellation policy.

The touring vehicle is not wheelchair accessible. The company is not responsible for lost or stolen items. Customers must acknowledge that their participation in the tour is voluntary, and they assume all risks associated with the tour. The risks involved may include uneven walking surfaces, raised path edges, wet or slippery ground, steps, curbs, low lighting, narrow walkways, traffic movement, road crossings, diversions due to construction or exposure to weather conditions, etc. The customer releases and waives all claims against the company and its affiliated entities for any injury, loss, or damage incurred during the tour, including those resulting from negligence.

The customer agrees to indemnify and hold harmless the company and its affiliated entities from any loss, liability, damage, or cost resulting from claims brought against the company by third parties related to the customer's participation in the tour. The customer grants the company a royalty-free license to use their photographic, video, or digital likeness for promotional, educational, and/or Personal Winery Tours purposes. Finally, the customer authorizes the company to provide customary medical assistance, transportation, and emergency medical services if necessary.

No-Show Policy: A No-Show fee equal to the trip cost plus applicable waiting time, loss of deposit, and gratuity will be charged when the person in charge of the tour (and others in the group) fails to show up at the designated location for which they have booked a Wine Tasting Tour.

If any portion of this Waiver is held to be invalid, it is agreed that the balance of the Agreement will remain valid and enforceable. ​ By reserving a seat on our tour, you acknowledge that you have read, understand, and accept these terms and conditions before going on a guided tour with Personal Winery Tours. ​  The customer agrees that, by accepting this document, he/she will be held accountable for all actions (and their consequences) taken by his/her fellow tasters.
